Terms of Service

These Terms of Service ("Terms") govern your use of tenpace.com and Tenpace products (the "Service"), operated by Tenpace Inc. ("Tenpace", "we", "us", "our"). A product may provide supplemental terms for features unique to that product. By accessing or using the Service, you agree to these Terms and any applicable supplemental terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Tenpace builds software that makes important actions easier to repeat and harder to miss. Current products include:

• Review Router, which routes GitHub pull request context and review ownership through Slack
• Tenpace Health, a public consumer wellness beta for training, nutrition, progress tracking, and private accountability Circles

3. Account Registration

To use the Service, you must create an account by authenticating with a supported provider (GitHub, Google, or email). You are responsible for:

• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

4. Plans, Trials, Billing, and Cancellation

Some products have free plans and others require a recurring subscription. The price, billing interval, included quantity, trial terms, and any applicable taxes are shown before you confirm a purchase. Organization administrators represent that they are authorized to purchase for their organization.

A card-required trial automatically becomes a paid subscription at the disclosed price when the trial ends unless you cancel first. A no-card trial does not charge you unless you later choose a paid subscription. Trials are limited to one activation per billing account and product unless Tenpace expressly states otherwise.

Paid subscriptions renew automatically for the selected monthly or annual interval until canceled. You can cancel renewal through Billing settings; cancellation normally takes effect at the end of the current paid period, and access continues until then. Except where required by law or expressly stated at purchase, fees already paid are non-refundable. Tenpace may change future prices with advance notice. A stated founding rate remains in place only while the qualifying subscription stays continuous.

Payments are processed by Stripe. You authorize Tenpace and Stripe to charge the payment method associated with your billing account for recurring fees, prorations, and applicable taxes disclosed through the checkout or billing flow.

5. Referral Program and Credits

Referral rewards are promotional account credits, not cash. Unless a displayed offer says otherwise, a referral qualifies only after the referred customer's first positive payment remains unrefunded and undisputed for 30 days. The reward is capped at the lesser of one month of the referrer's then-current eligible plan or that first net payment, with no more than 12 confirmed rewards per calendar year. Work and personal product credits remain in their respective billing families.

Self-referrals, duplicate or fabricated accounts, misleading promotion, payment abuse, and other attempts to manipulate the program are prohibited. Tenpace may reject or reverse a credit connected to a refund, dispute, fraud, error, or violation of these Terms and may change or end the program prospectively.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to send spam or unsolicited messages
• Exceed reasonable API rate limits or abuse webhook endpoints
• Impersonate another person or entity

7. Third-Party Integrations

The Service integrates with third-party platforms including GitHub, Slack, and Google. Your use of these integrations is subject to the respective terms of those platforms. We are not responsible for the availability, accuracy, or policies of third-party services.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Health and Wellness Features

Tenpace Health is a consumer wellness product, not medical care. It does not diagnose, treat, prescribe, or guarantee health outcomes and is not a substitute for a qualified healthcare professional. Do not use it for emergencies. Health beta users must be at least 18 years old and also agree to the Tenpace Health supplemental terms.

10. Intellectual Property

The Service, including its design, features, and content, is owned by Tenpace and protected by intellectual property laws. You retain all rights to your data and content that you provide through the Service.

11. API and Webhook Usage

If you use our API or webhook features:

• API keys are confidential and must not be shared publicly
• Webhook secrets must be verified using HMAC signature validation
• We reserve the right to rate-limit or suspend API access for abuse
• Webhook endpoints that consistently fail may be automatically disabled

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

13. Beta Access

Review Router and Tenpace Health currently permit public-beta account creation. Other products may use staged or limited rollouts. Beta products may be provided at no charge or under a clearly disclosed paid or trial offer. We may limit or suspend access to protect the Service or address abuse. Beta features and terms may change or end with reasonable notice and do not guarantee continued access on the same terms after the beta.

14. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases, and we may delete your data after a reasonable retention period.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law, Tenpace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
